Abstract

Roughly a decade and a half has elapsed since scholars first began to notice that “courts are talking to one another all over the world.” Since then, transnational judicial dialogue has emerged as an important force in the development of international human rights law and in the emergence of domestic courts as transnational actors. This presentation explores the impact of transnational judicial dialogue to date, using the death penalty as a case study to explore broader trends.
