Abstract

This thesis is concerned with Chinese migrant workers such as Mr. Jia and their need for fair and accessible legal representation. In this regard, Zhicheng Public Interest Lawyers provides an exemplary case study of a Chinese legal NGO, being highly dedicated to legal aid for the massive but vulnerable migrant worker population. In order to explain the role of Zhicheng in Chinese society, it is first necessary to examine the contemporary migrant worker crisis in China, involving millions of mostly uneducated rural-to-urban migrants, who are routinely exploited by their employers. Where can these migrants turn for help? The Chinese government has set up a system of state-run legal aid centers. However, these centers are understaffed and often refuse to accept migrant workers’ cases, based on China’s discriminatory household registration system. Given these national problems, this thesis focuses on the important role played by legal NGOs such as Zhicheng. In the final major chapter of this thesis, the case of Zhicheng is examined in detail to uncover the important roles it plays not only in legal provision to migrant workers, but also in improving and advancing Chinese labor law.
